Un juez de control del Sistema Procesal Penal Acusatorio del Poder Judicial de la Ciudad de México ordenó el arresto por 36 horas de los conductores Paty Chapoy, Daniel Bisogno y Ricardo Manjarrez, del programa Ventaneando, mencionados dentro de una carpeta judicial.
Sin embargo, la orden de arresto fue frenada por la jueza Rosa María Cervantes Mejía, titular del Juzgado Decimosegundo de Distrito de Amparo en Materia Penal en la Ciudad de México, quien les concedió una suspensión provisional.
“Se concede la suspensión provisional que solicita la parte quejosa para el efecto de que las responsables, respectivamente, en caso de no haberlo realizado notifiquen a la quejosa de manera personal la medida de apremio consistente en un arresto por 36 horas, emitida en la carpeta judicial **”, se puede leer en las listas de acuerdos del Consejo de la Judicatura Federal.
Los arrestos de esta índole suelen ordenarse cuando un testigo en un proceso penal se niega a comparecer por propia voluntad, por lo que al ordenar su arresto provisional se busca que las personas acudan a comparecer ante las autoridades.
En esta listas se especifica que el amparo fue presentado el día de ayer por los tres conductores del programa televisivo que buscan protegerse contra la omisión de las autoridades de notificar de manera personal la medida de apremio antes mencionada.
En los registros judiciales no se especifica la falta u omisión que se les imputa a los conductores, pero se especifica que la autoridad no notificó en tiempo y forma sobre su intención de arrestarlos.
Por eso la jueza Cervantes Mejía también concedió la suspensión provisional para que, en caso de que dicha orden de arresto aún no se haya ejecutado, las autoridades responsables se abstengan de llevar a cabo la detención en tanto no se dicte la suspensión definitiva.
En caso de que dicha orden de arresto ya se encuentre ejecutada, la jueza también ordenó suspender la misma a efecto de que se les ponga en inmediata libertad, siempre y cuando la privación de su libertad sea en cumplimiento de la orden de arresto decretada en este caso y no en otro.
De esta forma, la jueza señaló el 27 de marzo de 2023 como fecha para realizar la audiencia en la que decidirá si les concede el amparo definitivo y el 13 de abril para la audiencia en la que decidirá si les otorga en amparo de la justicia.
