El magistrado José Antonio Belda Rodríguez consideró que la decisión de autorizar la operación de UBER no afecta a quienes prestan el servicio de transporte público, y sí ayuda a los usuarios, pues les ofrece mayores opciones de servicio.
La mañana de este miércoles, el Poder Judicial discutió el amparo 334/2019, el cual busca que Uber pueda operar en Quintana Roo sin necesidad de tener una concesión.
La ley establece que todo servicio de transporte debe operar por medio de una concesión dado que lo considera transporte público.
Sin embargo, la empresa afirma que es del sector privado, por ello se amparó ante lo que establece la Ley de Movilidad vigente.
Fueron los magistrados José Antonio Belda Rodríguez, Jorge Mercado Mejía y Leonel Jesús Hidalgo, quienes discutieron el tema y votaron la resolución del mismo.
Se registraron dos solicitudes del Sindicato de Taxistas para que el magistrado ponente Jorge Mercado Mejía se abstuviera de participar en el debate y discusión. Sin embargo estos recursos fueron desechados por el pleno.
La plataforma demostró, según el magistrado ponente, ser una empresa privada, una sociedad mercantil que ofrece servicio de transporte con chofer mediante dispositivos electrónicos y aplicaciones digitales.
Esto confirmaría que por lo tanto no es transporte público y por ello no requiere de una concesión, tal como lo exigen las autoridades de Quintana Roo.
El argumento que rige el proyecto señala que el servicio de transporte ofrecido por plataformas digitales y dispositivos electrónicos no puede equipararse al transporte público que brinda el estado, ya sea de manera directa o a través de terceros, es decir, concesionarios, detalló Jorge Mercado Mejía.
El servicio de transporte vía aplicaciones un modelo de negocio diferente, por lo que no sería concesionable. Y el servicio de taxis sí se opera a partir de concesiones, pues la Suprema Corte así lo establece.
El magistrado resaltó que la Suprema Corte ya discutió el mismo tema en otros estados, y consideró que el servicio de plataformas no puede ser considerado servicio público.
